This compares how much credit is available to you to how much credit you actually borrow,” explained Stephen Hart, CEO of  Cardswitcher.A high balance-to-limit ratio, where you borrow a large amount of money, is usually considered a sign of increased financial risk by lenders and a low balance-to-limit ratio is considered good.”Still not sure how your credit utiliz ation ratio works? Here’s an example from CPA Logan Allec  (@moneydoneright), owner of personal finance website  Money Done Right:“Lets say you have a total credit balance of $4,000 across all your credit cards.  Now lets say you have a total credit limit across all of your credit cards of $20,000. In this case, your total utilization rate is 20 percentâ€"or $4,000 divided by $20,000.“Now, what if one of your credit cards has a $10,000 credit limit, and you cancel it? In this case, your total credit limit across all of your credit cards would go down to $10,000. What would happen to your total utilization rate?  It would skyrocket to 40 percentâ€"or $4,000 divided by $10,000, which could adversely affect your credit score.”For the sake of your credit score, it’s best to keep your credit utilization ratio below 30 percent. Even if you’re paying off your cards every month, you should try to avoid accruing more than 30 percent of your total limit at any one moment in time .And if you’re thinking about closing that one card that has a super high credit limit, maybe don’t.Closing old cards dings your credit history.Remember, the length of your credit history doesn’t just measure how long you’ve been using credit, it also tracks how long you’ve been using specific accounts. The longer you’ve had a credit card, the more it helps your score.“While its not as weighty a factor as payment history or credit utilization,” says Allec, “its still worth paying attention to.” And he’s right! Closing your oldest card will lower the average age of your accounts, likely dropping your score.“This is why I keep my oldest credit cardâ€"the one I opened in collegeâ€"open,” added Allec. “Even though I dont use it because its rewards structure is a boring one percent back on everything.”And if you’re not certain which of your credit cards is the oldest, Allec offered this tip: “Make a list of all of them and see if you can see online which one is the oldest based on their statement dates.”Looking to erase past mistakes? Not so fast. One of the reasons that someone might look to close an old card is because they think it will remove any bad information related to that card from their report.Unfortunately, it will not.Bear in mind that the credit card isnt erased from your credit record straight away,” said Hart. “Negative entries usually stay on your credit record for around seven yearsâ€"so it isnt necessarily a quick fix for making your credit history appear rosier than it actually is.”“The good news,” he added, “is that positive entries stay on your credit record for much longerâ€"usually a decade.Keep them openâ€"just don’t use them.As you can see, the reasons for keeping an old card open are generally more compelling than the reasons to close it. Still, in case you’re not convinced, here are a couple more common reasons that people close their old credit cardsâ€"and ways that you can get around them:“If your newer cards provide better reward deals, just use them as your main cards while using the older, longstanding card once in a while to keep that account active (and keeping its high credit limit as part of your credit file),” said Wiedman.“If you have high balances on other credit cards, you might find that youre faced with charges when you try to close your credit card account. A way to avoid this to make sure that you pay off the balances of all your accounts in full before you try to close any,” offered Hart.“If your reason for wanting to cancel a credit card is its high annual fee, call the credit card company to see if they will waive it for the year,” advised Allec.Just make sure you don’t do one thing, and that’s to start using the card to spend beyond your means and rack up excess debt! Relevant Law A Legally Binding Contract In English law, the traditional approach to determining whether or not a binding agreement has been entered into is to examine whether or not the following three elements are present: offer, acceptance and consideration (New Zealand Shipping Co. Therefore, the position in general regarding instantaneous forms of communication is that the law in this regard seems to indicate that acceptance is effective on receipt. Finally, it is also worth noting that the terms of an offer must be unconditionally accepted otherwise any attempt to introduce new terms shall constitute a counter-offer (Hyde v Wrench). Advice to the Parties Analysis of the Law Albatt initially offered the contract for the service of their electronic processors to Budgett. The letter outlining this offer indicated that Budgett should reply by return of post. The case law in this instance suggests that a reply by post or an equally expeditious method will be acceptable (Tinn v Hoffman and Co). However, the letter did not reach Budgett until 6th September, due to an error in the address which was put on the letter. Nevertheless, Budgett did receive the letter on 6th September and, immediately upon receipt, accepted the offer and posted the acceptance letter at 11:00AM on the same day. According to the case law, the postal rule dictates that Budgett’s letter shall constitute an acceptance once it had been validly posted (Brinkibon Ltd v Stahag Stahl und Stahlwarenhandelsgesellschaft GmbH). However, Albatt had agreed by telephone to offer Cansys the contract on 5th September after not receiving any reply from Budgett, and Cansys duly accepted the offer. That said, Albatt did not send a notice of withdrawal of the original offer to Budgett until 6th September. This notice was sent by fax, which is an instantaneous form of communication (Entores v Miles Far East Corporation). A notice of withdrawal sent via this method shall become effective once it has been received if sent during office hours (The Brimnes). This is the case irrespective of whether or not the other party has had sight of the notice. The Legal Position of the Parties Albatt Albatt’s legal position revolves around the issue of when the fax setting out the notice of withdrawal was sent to Budgett. If it had been sent prior to 11:00AM, on 6th September, then it would appear that Albatt had not entered into a legally binding agreement with Budgett (The Brimnes). However, if the fax was sent after 11:00AM the issue would turn on when Budgett’s acceptance letter had been validly posted (Brinkibon Ltd v Stahag Stahl und Stahlwarenhandelsgesellschaft GmbH). If the letter was validly posted prior to the notice of withdrawal being received, Albatt will have entered into a contract with Budgett. If not, only the contract with Cansys will be valid. In light of the fact that the fax was received by Budgett at 10:30AM, no legally binding contract had been entered into between Albatt and Budgett (The Brimnes), irrespective of the fact that nobody read the fax until 5:00PM. Budgett Budgett’s legal position turns on the issue of when its letter of acceptance was validly posted, as set out above (Brinkibon Ltd v Stahag Stahl und Stahlwarenhandelsgesellschaft GmbH). If it the letter was validly posted before Albatt’s notice of withdrawal was received, Budgett can sue for breach of contract if Albatt does not honour the agreement. If the notice of withdrawal was sent outside normal business hours, however, it would not become effective until the following day (providing that this was a normal working day) (Mondial Shipping and Chartering BV v Astarte Shipping Ltd). It is noteworthy that a court would place much emphasis on the intention of the parties (Brinkibon Ltd v Stahag Stahl und Stahlwarenhandelsgesellschaft GmbH). However, given that Albatt’s fax was received by Budgett at 10:30AM on 6th September, a court would find that no contract had been entered into between the parties (The Brimnes). Nonetheless, Budgett may have a claim in neglige nce due to the mistake in the address put on the offer letter which was sent on 1st September and was directly responsible for the delay in Budgett’s acceptance being communicated to Albatt. Cansys Cansys communicated an offer to Albatt to do the servicing work on 4th September for ?160,000, per annum. However, the terms of an offer must be unconditionally accepted otherwise any attempt to introduce new terms shall constitute a counter-offer (Hyde v Wrench). Therefore, Albatt’s offer to give Cansys the contract for ?155,000, instead of ?160,000, would constitute a counter-offer which would negate the original offer. Years of Growth After 1783 more and more people set off for the new territories between theAppalachian Mountains and the Mississippi River that the Treaty of Paris had granted to the US. Meridians, who already lived on these lands saw the settlers as thieves who had come to steal their hunting grounds and made fierce attacks on them. In 1830 the US government passed a law called the Indian Removal Act. The law said that all Indians living east of the Mississippi River would be moved west. Why Teaching is Fun Full Disclosure: Inspiration can come from anywhere. This morning I was telling my seven-year-old son that I had to write an article. I told him that I did not even know what I was going to write about. He immediately said, â€Å"Why don’t you write about why teaching is fun.† Thank you Kaden for inspiring me! Teaching is fun! If you are a teacher and do not generally agree with that statement, then perhaps it is time for you to find another career choice. I would agree that there are days when fun is not a word I would use to describe my profession. There are times when teaching is frustrating, disappointing, and disheartening. However, generally speaking, it is a fun profession for many reasons. Teaching is fun†¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦because no two days are the same. Each day brings a different challenge and a different outcome. Even after teaching for twenty years, the next day will present something you haven’t seen before.Teaching is fun†¦Ã¢â‚¬ ¦Ã¢â‚¬ ¦because you get to see those â€Å"light bulb† moments. That is the moment where everything just clicks for a student. Accept your situationMy husband likes to worry- he frets about losing his job, losing the freelance work he does on top of his job, losing the remote if I don’t put it back in the little box he set up specifically for that purpose. What if the remote does fall off the couch and break?† I accept that upsetting things can happen- I know I’ll be worried and unsettled when they happen, too. But I also know weà ¢â‚¬â„¢ll bounce back. I can’t preemptively carry around all that worry. This is an uncertain time. I know it. He knows it. One of us has a positive attitude- the other is perpetually bracing for the sky to fall.2. Embrace new hobbiesOnce you’re not worried about what you need to prepare for, you have the freedom just to prepare for whatever interests you. More than anything employers want to see prospective candidates who have interests, passion, and knowledge they can bring into their new job in unexpected, exciting ways. If nothing else, you’ll be distracted- but best-case scenario you’ll uncover something spontaneous and fulfilling that will take you somewhere you never anticipated.3. Write down your thoughtsThis is huge, especially when you feel overwhelmed and bombarded on all sides. Write it down. Write down what you’re sure of and what you’re unsure about, what you know and what you don’t. Whether it’s as simple as maki ng a list or as involved as a daily journal, try to record all the ideas that fluctuate through your brain in times of stress. When you page through it later you may notice patterns, goals, ideas in need of further development, or hopes you hadn’t even quite acknowledged to yourself!I make a lot of flow charts when I’m stressed. Diversity training has become a necessity in businesses today. Diversity training is necessary because of people’s differences in our work force. Some of these differences are race, gender, culture, age, and disabilities. Because our organization is so diverse, this program will help educate, sensitize and prepare people to get along in our workplace.   Ã‚  Ã‚  Ã‚  Ã‚  If done right, I feel that the training programs will bring our company promising results. One study by Katrina Jordan on diversity training in the workplace from the perspective of organization/human resources diversity practitioners and diversity consultants showed positive results. Some of the outcomes found in this study were changes in staff behavior, increases staff sensitivity, increased executive commitment, recognition that diversity training is not just a H.R function, etc. For some diversity training â€Å"empowers people by helping them to understand others and develop a world view beyond their own. As a result they know how to respond to and resolve differences that might otherwise interfere with their work†(Jordan).   Ã‚  Ã‚  Ã‚  Ã‚  Programs are made up to cover a wide range of topics. These topics include defining, developing and managing diversity, harassment prevention, cross cultural communication, and creating an affirming environment. Workers will be able to bring up their own specific topics as well.   Ã‚  Ã‚  Ã‚  Ã‚  Training sessions will be of two types. First we will have a series of speaker’s come in at least once every other week and talk to large groups no larger than 75 people. Also during the week between smaller groups of no more that 20 people will meet for discussions. All sessions will be held at times convenient to all employees. To try to create an informal environment we will serve coffee and donuts.   Ã‚  Ã‚  Ã‚  Ã‚  For the training programs to make a positive impact it is important for all levels of employees to take part. Training must begin from the top down. H.R participants say that it is essential for top executives to take part in these training sessions. Middle management will be stressed to attend, since they are doing a lot of interaction with people.

Kant the Sublime Essay

The Sublime In Lyotard’s reading Lessons on the Analytic of the Sublime, he explains how critical thought exists within an infinite amount of creativity with no principles but in search of them. Lyotard understands the Kantian sublime as a way to comply with the standards that critically analyze postmodernism using deconstruction. Kant differentiated the sublime between the vastness and greatness and the dynamic sublime. The vastness sublime is so great we can’t just use our senses like we normally do; it requires us to heighten our senses beyond comprehension. The dynamic sublime is the way in which rationalizes things and his perceptions. Lyotard describes the boundlessness of the imagination and reason as a ‘differend’ and this is ‘to be found at the heart of sublime feeling: at the encounter of two absolutes equally present to thought, the absolute whole when it conceives, the absolutely measured when it presents. ’ (Lyotard) Our imagination understands forms and measures while reason understands something without form of an infinite nature of something. There is a separation of imagination and reason and when we use the ‘enigmatic’ power of critical thought we can reflectively judge something. Kant’s presentation of the sublime has been taken up by Lyotard and he explores different ways of finding a philosophical understanding of different artworks. Through Longinus and Burke we can explore the pre-modern and modern conceptions of the sublime and through all these critiques we can draw different manifestations of the sublime in art. Kant questions how can someone judge an object before knowing how to properly judge that object and how do they know what proper judging is? Longinus in part of his critique implies that man can go beyond his limitations as a human being by experiencing emotions and language. The art or technical talents was described, as the human while the sublime was something that escaped our experience of art. ‘Sublimity consists in a certain excellence and distinction in expression’ (Longinus, pg 100). To understand and have knowledge of the sublime, there needs to be a vague understanding of something that is beyond our experience or senses. He explains that there is more to the human ordinary life because we feel this through the senses, but these senses are an incorrect interpretation caused by a physical perception as opposed to a psychological one. If you think about the sublime, it cannot be pictured or imagined but we have translated and suggested through the arts and poetry. Longinus tells us that nature is the creative and the first principle of the sublime and what follows is a matter luck and good mentors. In Goodbye Lenin, a German film directed by Wolfgang Becker, Lenin tries to hide the unification of Germany during the 1990’s from his mother who was in a coma throughout those months and has to stay in bed. He successfully conned her into thinking nothing had changed by using tricks like old product bottles and filming his own news broadcasts. This film successfully executes the idea of the sublime in what was going on between his mother and the rest of the world. ‘Our faults spring from the same place as our virtues. ’(Longinus)She believed everything around her was real and time had not changed but the people around her were well aware that this was a deception of reality. The way in which Lenin created the same world and reality his mother had always known is overwhelming to the senses and questions what is really for real? Burke believes that the ideas of pain and pleasure cannot be defined, but pleasure of every kind satisfies quickly. He goes on to say that there are two kinds of pleasure: the first that simply is and has no relation and the second that cannot exist without relation. The film has preserved and stopped time that defies nature and in reality cannot be done. The son is so scared and terrified that his mother will die that he tries to please her by keeping the world exactly the same. This terror is the source of sublime because it creates the most emotion and he imagines the worst. The fear that his mother will die has caused him to be terrified. It explores different areas of the mind by letting her believe this lie. His mother would not survive the fact that everything she has believed in had crumbled while she was asleep and that the world she once knew was suddenly a capitalistic society that now included Burger king, Pepsi and Coca-Cola. Lenin did not want to devastate his mother and cause another heart attack so he had to make everything appear, as it always was wile the outside world was growing and expanding at such an accelerated rate. The kitsch setting of the typical German 1989 apartment filled with yellow flowered wallpaper and dark wood furniture brings calmness to his communist mother. The film captures the nature of humans and their strong social beliefs and how it can affect the human psyche. Burke believes that terror is the source of the sublime and that pain is the more powerful than pleasure. Lyotard believes that pain is not the end point, there is the ‘movement’ of pain to ‘pleasure’ In Joseph Turners Impressionistic painting titled Slave Ship, he has created a seen of vastness that relates to the Kantian sublime but moreover he has demonstrated the use of color and dynamic composition to create a sense of horror. The brushstrokes give a natural look to the painting and the seemingly unintentional brushstrokes create an organized composition. We are aesthetically pleased when we look at the painting because an overwhelming response is experienced when looking at the picture. Burke believed that the Beautiful was very different from the sublime. â€Å"All privation is great because they are all terrible: Vacuity, darkness, solitude, and silence. Low and intermittent sounds and shadows bring about feelings of the sublime. Above all, the actions of the mind are affected by the sublime. â€Å" The way in which Turner has used rough brush strokes and lots of contrast between moods and contrasting colors creates the Sublime as opposed to the Beautiful. The use of purple and blue shadows that cast over the foggy night, the bloodline skyline, the flaming enraged sea and the insignificant ship create a sense of horror. The Sublime is experienced in this painting because it is detached from the actual danger of being in an actual situation and rather experienced through the visual arts and poetry in its overwhelming vastness. There is a sense of elation and intimidation when traveling through the painting. Thomas Cole’s Landscape with Tree Trunks create a struggle to be able to understand what is being implied. It becomes uninviting to the viewer as the scary tree trunks in the foreground block our path into the painting and we get further into only for our view to be blocked again because of the mountains that come right into the middle part. The painting does not accommodate to human feelings. These are sublime components such as the scary trees, the contrasting light and dynamic sky create frustration in entering the painting make us feel that we are not welcomed and that we are in a wilderness that we cannot control. The overwhelming tree and sky not only creates and unexplained phenomena but also implies that time and power of nature is vast and infinite and these unpredictable forces can in themselves become sublime. The painting composition seems to have been distorted by Cole yet it feels genuine and believable. In the Pianist directed by Roman Polanski we are safe to knowing the reality of the actual circumstance of Jewish victims trapped in a concentration camp but we still enjoy the horrific actions taken against them caused by the overwhelming power of human nature. We are awed, disgusted and in disbelief by the question: â€Å"How can human beings do such things? † ‘There is no explanation for the communication of passion, but it is concluded through the experience or premonitions of others. ’(Burke) there is no way to rationalize how the Jews were treated during this time of suffering and we can’t even fathom such events to reoccur, but it still exists today. The pain and suffering that we experience as a witness is subliminal and in cannot be justified. Within the film Szpilman is able to detach from the war and all the pain and suffering he has experienced by playing the piano. When different men have a common faith in the object of admiration we come to the Sublime’ (Longinus). Szpilman creates his own sublime world through the piano. He creates a stimulus of powerful and inspired emotion and he seems to be dignified and elevated when playing the piano, not guilty or ashamed for being a Jew. His talent brin gs even his worst enemies to respect him and be in completely awestruck by his music breaking all boundaries of human laws and standards and elevating itself to a much higher place that is universal. The unknown and unbound is created in the film when everyone is awestruck and in total admiration of the music. In the end, art has the vastness that allows the mind to be free of obstacles of distraction. Basically, I understand Kant in his way of thinking of art as a way of means to letting the senses experience a feeling far greater than the everyday ordinary life and sublimity only exists in our minds and not in nature, and if we are conscious of this we can become superior to nature within and to nature which does exists without us. Lyotard explains that art should work with no rules and that it therefore cannot be judged and instead be combined and pluralized. Longinus explains that the human is the technical aspect of art while the sublime is the existential part of the human psyche that goes beyond our experience of art. Burke’s modern view of sublimity in art can only be experienced through actual knowledge an actual experience where things are only recreated and reordered. He thinks that death and fear are feelings of the sublime and that what one might expect is very different to what actual really happens and that expectation creates fear which in turn makes us unreasonable and therefore brings about the sublime.
